Four Brown Deer Middle Students, ranging in age from 11-14, were arrested over an alleged sex party the students were involved in over the winter break. The incidents occurred at a residence in Brown Deer, Wisconsin and the students are believed to have captured some of the sexually explicit activity on their phones, although there was no indication that the depictions were published on social media sites. Police Chief, Michael Kass, is recommending that the juveniles be charged with first or second-degree assault. Brown Deer is about 18 miles from Milwaukee.
COMMENT: Although juveniles in Wisconsin can be waived in to adult court as young as 14, it is unclear whether this would occur here. Even though the Chief is recommending the most serious charges, given the lifetime stigmatism such charges potentially carry, it is unlikely that prosecutors will ultimately seek actual convictions for these charges. There are sentencing procedures in place that allow for convictions to be stayed if the offender completes certain conditions such as treatment. This would appear to be the appropriate course to take here, if the allegations are true.
