The Supreme Court granted the Roman Catholic Diocese (RCD) of Brooklyn’s Application for an injunction pending the completion of the appellate process below.
The appellate case below is in the United States Court of Appeals for the Second Circuit; significantly, the Supremes noted that RCD would likely prevail in the lower appellate court; the Supreme Court’s application was filed on an emergency basis, thereby interrupting the proceedings below.
The case is notable for other reasons beyond the justified enjoinment of the Governor’s unconstitutional rules. Associate Justice Amy Barrett joined the majority in the 5/4 Opinion at a time when Chief Justice Roberts, a Republican nominee (George Bush), joined with the liberal minority that opposed the Application.
